Government Reveals Environmental Control Strategy of Job Creation Law in DIL UNDIP Webinar

SEMARANG – The government, through the Director of Business Environmental Impact Prevention, and Activities of Directorate General of Forestry Planning and Environmental Management of Ministry of Environment and Forestry, Ir Ary Sudijanto, M.SE., reveals the environmental impact control strategy regulated in Law No.11 of 2020 on Job Creation Law (UU Cipta Kerja). In the forum, it is also stated that environmental control is getting stronger because it is supported by advanced technology in its supervision and implementation.

In National Webinar held by Environmental Science Doctoral Program (Doktor Ilmu Lingkungan) of Diponegoro University (UNDIP), on Wednesday (11/25/2020), Ary Sudijanto said that environmental control, which is originally based on licensing, in Job Creation Law is changed to be risk-based. The change does provide convenience but does not change the commitment to protect the environment.

According to Ary, for businesses that have a big risk, there is still a need to attach an environmental impact analysis (analisis dampak lingkungan), while for those with a small risk, environmental supervision is included in the Business Identification Number (Nomor Induk Berusaha). In making of environmental impact analysis, the government involves the community in public consultations and announcements.

In essence, Job Creation Law covers all environmental aspects, be it environmental permits, environmental impact analysis for industry, management permits and others. In Job Creation Law there is also a division of types of businesses and/or activities based on the Law documents. The government is currently deploying an aspiration team to seek improvements in its implementation.

With regard to criminal sanctions in their application, it is confirmed that they still exist, especially as sanctions for defamation. Meanwhile, administrative fine provisions are also made with different calculations that make more sense. For example, for wastewater quality standards related to administrative sanctions, it will be calculated based on errors. It is even related to health, safety, and the environment, so there are administrative sanctions for repair and fine for companies. “So the Act (Job Creation Law) does not weaken the environment but aims to strengthen the environment”, he explained.

As well known truth, environmental problem is one of the sectors affected by the implementation of Job Creation Law. There are many elements which are originally regulated in the Environmental Law undergoing changes. Responding to this condition, UNDIP Environmental Science Doctoral Program holds a National Webinar to find solutions of potential problems due to these changes.

Dean of UNDIP Postgraduate School, Dr. RB Sularto, S.H., M.Hum., in the opening of event stated that Law Number 11 of 2020 concerning Job Creation is like a newborn and is treated in various ways. Considering that the law has not been implemented, the impact cannot be seen.

This webinar is expected to provide academic suggestions on validation of Job Creation Law, so that it can predict potential environmental impacts. “I hope that the participation of participants and resource persons will provide ideas, and become materials that can produce studies in the future”, hoped Sularto.
